TERMS OF SERVICE

These Terms of Service ("Terms") govern use of the TRUEWILD Featherworks website and purchases or services provided by TRUEWILD Featherworks, LLC ("TRUEWILD," "we," "us," or "our"). By using the website, placing an order, paying a deposit, or authorizing custom work, you agree to these Terms and the policies referenced in them.

1. ELIGIBILITY AND ACCEPTANCE

You must be legally capable of entering a binding agreement. If you act for another person or organization, you represent that you have authority to bind them.

We may refuse service, decline a specimen, cancel an order, limit quantities, or require additional information when reasonably necessary for legal compliance, safety, availability, fraud prevention, or quality control.

2. WEBSITE INFORMATION

We work to keep descriptions, photographs, prices, availability, and other information accurate. Minor errors, omissions, or changes may occur. We may correct information or update the website without prior notice.

Colors and details may appear differently depending on screens, lighting, natural materials, and product variation.

3. MERCHANDISE ORDERS

Submitting an order does not guarantee acceptance. An order is accepted when payment is approved and TRUEWILD confirms or fulfills the order. We may cancel or refund an order if an item is unavailable, pricing is incorrect, fraud is suspected, or fulfillment is not reasonably possible.

Prices may change without notice. Applicable shipping charges and taxes are added at checkout or invoicing.

4. CUSTOM TAXIDERMY AND FEATHER ART

Custom work begins with consultation and project acceptance. A 50% non-refundable deposit is required to reserve production time. The remaining balance is due before pickup or return shipment.

The customer understands and agrees that:

- Each project is handmade from natural materials with unique condition, anatomy, coloration, and feather characteristics.
- Inspiration photographs and prior work are references, not guarantees of exact duplication.
- TRUEWILD may make reasonable artistic, structural, preservation, and safety decisions needed to produce a durable finished piece.
- Additional requested features, habitat work, repairs, changes, specialized packing, or shipping may result in additional charges disclosed before completion when reasonably practicable.
- Estimated completion dates are estimates and may change due to workload, materials, specimen condition, drying or curing needs, supply delays, or circumstances outside our control.

5. LEGAL HARVEST, OWNERSHIP, AND DOCUMENTATION

By delivering or shipping a bird or other specimen to TRUEWILD, the customer represents that it was lawfully harvested, acquired, possessed, transferred, and shipped, and that the customer has authority to request the work.

The customer is responsible for supplying all required federal and state tags, possession information, harvest information, permits, licenses, and other documentation. TRUEWILD may refuse or return any specimen that lacks required documentation or that we reasonably believe cannot lawfully be accepted or worked on.

6. SPECIMEN CONDITION AND RISK

The customer is responsible for proper field care, freezing, packaging, tagging, and shipment to TRUEWILD. Decomposition, freezer damage, insects, broken or missing feathers, shot damage, pin feathers, contamination, thawing, and other pre-existing or shipping-related conditions can affect the finished result.

TRUEWILD will use reasonable professional care but cannot guarantee that every specimen is suitable or that hidden damage will not become apparent after work begins. If a specimen cannot produce a result that meets our standards, we may discuss alternatives, replacement materials where lawful and available, or cancellation of the work. The non-refundable deposit may be applied to planning, materials, evaluation, scheduling, and work already performed.

7. PAYMENT

Customers agree to provide current, complete, and accurate billing and contact information. Amounts not paid when due may delay pickup, shipping, or continued work.

Completed custom projects will not be released or shipped until the account is paid in full. After 30 days from completion notice, a storage fee of $25 per week applies until pickup or shipping arrangements are completed.

8. SHIPPING, PICKUP, RETURNS, AND REFUNDS

Shipping, pickup, returns, refunds, damage claims, deposits, and storage are governed by our Shipping Policy and Refund and Return Policy, which are incorporated into these Terms.

9. CUSTOMER COMMUNICATIONS

The customer is responsible for maintaining current email, telephone, billing, and shipping information and for responding to requests needed to complete or deliver a project. We may use the contact information provided to communicate about inquiries, orders, project status, payments, pickup, shipping, safety, or legal requirements.

10. INTELLECTUAL PROPERTY

The website, TRUEWILD name, logos, branding, text, graphics, layouts, photographs owned by TRUEWILD, and other original content are protected by intellectual-property laws. They may not be copied, reproduced, republished, sold, or used commercially without written permission.

11. REVIEWS, MESSAGES, AND SUBMISSIONS

Do not submit unlawful, infringing, deceptive, threatening, abusive, malicious, or privacy-violating content. You represent that information you submit is accurate and that you have the right to provide any photographs or materials submitted to us.

12. PROHIBITED USES

You may not use the website or services to violate law, infringe rights, submit false or fraudulent information, interfere with security, transmit harmful code, scrape or exploit content without authorization, or attempt unauthorized access.

13. THIRD-PARTY SERVICES AND LINKS

Shopify, payment providers, shipping carriers, social platforms, and other third parties provide services used by the store. Their terms and policies may apply. TRUEWILD is not responsible for third-party websites or services outside our control.

14. DISCLAIMER

To the fullest extent permitted by law, the website and its content are provided on an "as available" basis. We do not promise uninterrupted or error-free access. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, TRUEWILD Featherworks, LLC and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, merchandise, shipping, delays, or services.

Where liability cannot be excluded, our aggregate liability will not exceed the amount paid to TRUEWILD for the specific product or service giving rise to the claim, except where a different limit is required by law.

16. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold TRUEWILD harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful conduct, violation of these Terms, infringement of another person's rights, false harvest or ownership representations, or failure to provide required documentation.

17. GOVERNING LAW

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

18. SEVERABILITY AND WAIVER

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of that provision.

19. CHANGES

We may update these Terms by posting a revised version. The date at the top identifies the latest revision. Continued use of the website after an update constitutes acceptance to the extent permitted by law.
